Welcome to ChargeZone Plus LLC! These Terms of Service (“Terms”) constitute a legal agreement between you (“User,” “you,” or “your”) and ChargeZone Plus LLC (“we,” “our,” or “us”). By accessing or using our services, including power bank rentals, website, and mobile application (collectively referred to as the “Services”), you agree to comply with these Terms. If you do not agree to these Terms, do not use the Services.

1. About ChargeZone Plus LLC

ChargeZone Plus LLC, based in Virginia, USA operates a network of power bank rental vending machines across the United States and a mobile app to facilitate rentals. Our mission is to provide convenient portable charging solutions to keep users connected.

2. Eligibility

  • You must be 18 years or older to use the Services.

  • If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.

3. User Accounts

  • To access some features of the Services, you may need to create an account.

  • You are responsible for maintaining the confidentiality of your login credentials and are liable for all activities conducted through your account.

  • Notify us immediately at support@chargezoneplus.com if you suspect unauthorized use of your account.

4. Rentals

a. Initiating a Rental

You may rent a power bank by:

  • Scanning the QR code on a vending machine using our mobile app.

  • Using a valid credit or debit card (tap, swipe, or chip).

b. Usage

  • Each rental is subject to the pricing displayed at the time of transaction.

  • You are responsible for the power bank from the time it is dispensed until it is returned.

c. Return Policy

  • Return the power bank to any ChargeZone+ station to end the rental period.

  • Failure to return the power bank may result in additional fees, daily maximum fee of $25, including a replacement charge.

  • Power banks not returned within 48 hours will be deemed as “no-return” and a replacement fee of $25 will be charged for each power bank to the renter’s account.

5. Payment and Pricing

a. Payment Methods

  • By using the Services, you authorize us to charge your payment method for rental fees, non-return fees, or damages.

  • Ensure your payment method is valid and up-to-date.

b. Pricing and Fees

  • Rental fees are displayed at the point of rental.

  • All charges are final and non-refundable unless otherwise stated.

6. Refund and Cancellation Policy

  • Refunds are issued only for verified technical errors (e.g., failure to dispense a power bank).

  • If you wish to dispute a charge, contact us at support@chargezoneplus.com within 7 days of the transaction.

7. User Responsibilities

You agree to:

  • Use the power bank for its intended purpose (charging devices only).

  • Handle the power bank and vending machines responsibly.

  • Inspect the power bank for visible damage before use and report any issues immediately.

You must not:

  • Attempt to tamper with or damage the vending machines or power banks.

  • Use fraudulent payment methods or engage in illegal activities through the Services.

8. Maintenance and Downtime

We may temporarily suspend Services for maintenance, upgrades, or unforeseen circumstances. While we aim to minimize disruptions, we are not liable for any inconveniences caused by downtime.

9. Intellectual Property

  • All content on our platform, including logos, designs, and text, is owned by ChargeZone Plus LLC.

  • You may not reproduce, distribute, or modify any content without written permission.

10. Force Majeure

ChargeZone Plus LLC is not liable for failure to provide Services due to events beyond our control, including natural disasters, government actions, or technical failures.

11. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using our Services, you consent to these practices.

12. Warranties and Disclaimers

  • The Services are provided “as is” without warranties of any kind, either express or implied.

  • We do not guarantee uninterrupted or error-free operation of the Services.

13. Limitation of Liability

  • ChargeZone Plus LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Services.

  • Our total liability is limited to the amount paid by you for the Services in the 6 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless ChargeZone Plus LLC and its affiliates from any claims, damages, or losses arising from your violation of these Terms or misuse of the Services.

15. Third-Party Services

Our Services may integrate with third-party platforms (e.g., payment processors). We are not liable for the actions or policies of these third parties.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

17. Dispute Resolution

a. Initial Resolution

Contact our support team for disputes related to the Services.

b. Arbitration

Unresolved disputes will be settled through binding arbitration, waiving the right to a court trial.

c. Class Action Waiver

You agree to resolve disputes individually and not as part of a class or group.

18. Modifications to Terms

We may update these Terms periodically. Continued use of the Services constitutes acceptance of the updated Terms.

19. Entire Agreement

These Terms represent the entire agreement between you and ChargeZone Plus LLC, superseding any prior communications.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
